By accessing this website, requesting a quote, or engaging Joe’s Sydney Fencing, you acknowledge that you have read, understood, and agree to be bound by these Website Terms & Legal Disclaimer.

Quotes & Estimates Disclaimer

Online or verbal estimates are indicative only and subject to site inspection. Final pricing may vary depending on site conditions, materials, and scope of work. Joe’s Sydney Fencing is not bound by any estimate unless a written quotation has been issued and formally accepted.

All works are subject to written agreement.

 

No Professional Advice

Joe’s Sydney Fencing is an experienced residential fencing service provider.

However, information provided on this website (including blogs, FAQs, project descriptions, or responses via social media) is general in nature and may not apply to your specific circumstances.

Information published does not constitute:

  • Boundary surveying advice

  • Engineering design

  • Structural certification

  • Pool compliance certification

  • Council approval advice

  • Legal advice

Clients are responsible for obtaining appropriate independent advice and approvals where required.

All projects are subject to written quotation and compliance with relevant council and regulatory requirements. Where necessary, a site inspection may be required to confirm scope, pricing, and site conditions.

 

Limitation of Liability

We stand by our workmanship and always aim to do the job right. However, there are some things outside our control.

Joe’s Sydney Fencing is not responsible for:

  • Any problems that happen because someone relied solely on the information on our website without contacting us directly

  • Delays caused by bad weather or material supply issues

  • Boundary disputes or incorrect boundary information provided to us

  • Damage to underground services that were not disclosed

  • Unexpected site conditions that couldn’t reasonably be identified beforehand including hidden rock, unstable soil, tree roots, buried materials, or drainage complications.

Nothing in this disclaimer excludes rights available under the Australian Consumer Law. If something goes wrong due to our workmanship, we will fix it in line with Australian Consumer Law. Our responsibility is limited to repairing or replacing the affected work — we’re not responsible for indirect losses such as neighbour disputes or financial loss. To the extent permitted by law, our total liability is limited to the value of the works supplied under the contract.


Council & Regulatory Compliance

Property owners are responsible for ensuring compliance with:

  • Local council requirements

  • Pool fencing regulations

  • Height restrictions

  • Easement restrictions

  • Any applicable approvals or permits

Unless otherwise agreed in writing, Joe’s Sydney Fencing does not undertake responsibility for obtaining council approvals or certifications.

 

Deposits & Payment Terms

  • A deposit is required to secure your booking and order materials.

  • Payment terms, including any applicable progress payments, will be set out in your written quotation or contract.

  • Final payment is due upon completion of works unless otherwise agreed in writing.

  • Late payments may incur additional fees or interest as permitted under NSW law.

We accept payment via bank transfer and other agreed methods.

 

Scheduling & Delays

  • Installation dates are estimates and may be affected by weather, material availability, or unforeseen site conditions.

  • We are not liable for delays beyond our reasonable control.

  • Clients must ensure clear and safe access to the site on the agreed installation date.

     

Client Responsibilities

The client agrees to:

• Confirm correct boundary lines prior to installation.
• Obtain any required council approvals or permits (unless otherwise agreed).
• Ensure the worksite is safe and accessible.
• Secure pets and ensure children are kept clear of the work area.
• Disclose any underground services (e.g., plumbing, electrical, NBN).
• Ensure clear and unobstructed access to the work area. Removal of existing fencing, landscaping, debris, vegetation, concrete, or other obstructions not specified in the quotation may incur additional charges. Joe’s Sydney Fencing is not responsible for damage to undisclosed underground services.

 

Underground Services

Clients must ensure all underground services are identified and properly marked prior to commencement of works.

This includes, but is not limited to:

  • Electrical

  • Gas

  • Plumbing

  • Stormwater

  • Irrigation

  • NBN or telecommunications

Joe’s Sydney Fencing is not liable for damage to services that were not disclosed or clearly marked.

 

Variations & Additional Work

Any additional work requested outside the original scope will be treated as a variation and may incur additional charges. Variations must be agreed upon before work proceeds. If latent or unforeseen site conditions are encountered (including rock, unstable soil, roots, buried debris, or drainage issues), additional charges may apply. The Contractor reserves the right to suspend works until a variation is agreed in writing.

 

Cancellations

  • Cancellations after acceptance of quote may result in loss of deposit to cover administrative and material costs.

  • If materials have already been ordered, the client may be liable for associated costs

     

Warranty

We provide a workmanship warranty on installations in accordance with Australian Consumer Law.

Manufacturer warranties apply to materials supplied (e.g., Colorbond steel). Warranty does not cover:

  • Damage caused by misuse, impact, or modification

  • Natural wear and tear

  • Storm or extreme weather damage

  • Movement caused by natural soil conditions, drainage issues, ground settlement, or external structural loads beyond our control.

Intellectual Property
